42 E-commerce on US Watch List, Most from China


The United States has released the names of e-commerce companies that are included in the "Notorious Market List for 2021". Companies that are included in the US watch list are allegedly involved in intellectual property rights violations.

Generally, e-commerce companies that are included in the US watch list are from China. However, there are also Indonesian e-commerce companies that are on the US watch list.

As summarized by KompasTekno from USTR.Gov, Monday (21/2/2022), the Notorious Market List itself is made by the US Department of Commerce every year to help raise public awareness and protect intellectual property in the US, as well as the workers and business operations there.

As for selling counterfeit goods globally, according to a representative for the US Department of Commerce, Katherine Tai, it will also damage the creative industry, especially in the US.


"This activity also impacts those involved in the manufacture of counterfeit goods, and can pose a significant risk to the health and safety of consumers and workers around the world," added Katherine.

Apart from Tokopedia, Bukalapak and Shopee, the e-commerce giant AliExpress and the chat platform WeChat have also entered into US-controlled companies to sell or facilitate illegal products.

Then, there are also a number of companies that were previously on the Notorious Market List last year, and are still on the US watch list in 2021, such as Baidu, Pinduoduo, to Taobao.

So, who has the US put on the Notorious Market List as an online company that facilitates the sale of counterfeit and pirated goods in 2021?

The US said the 42 platforms or e-commerce companies were suspected of having been involved in or facilitating the sale of counterfeit goods. Of the dozens of online platforms, there are a number of new companies that are included in the list of companies monitored by the US government. Three of them are two marketplaces from Indonesia, namely Bukalapak and Tokopedia, as well as one e-commerce from Singapore that also operates in Indonesia, namely Shopee.

According to the US Department of Commerce, many branded goods sold on Bukalapak are labeled as counterfeit or replica goods. The same thing was also found at Tokopedia, where the US Department of Commerce said it found a number of counterfeit goods from various categories, such as clothing, cosmetics, accessories, books, and so on.

Similar to Bukalapak and Tokopedia, the US Department of Commerce also claims that it has found many counterfeit goods sold on the Shopee platform in several Shopee operational markets, except for Taiwan.

The US Department of Commerce said that Bukalapak, Tokopedia, and Shopee had actually made improvements to their systems, to eradicate pirated goods. However, it is considered still less effective and efficient.

Bukalapak and Tokopedia's Response

Regarding Bukalapak's entry into US supervision / Notorious Market List 2021, Bukalapak's AVP Marketplace Quality, Baskara Aditama, said that his party is always committed to protecting Intellectual Property Rights (IPR) and prohibiting the sale of counterfeit and pirated goods at Bukalapak.


"All violations of the Rules for Using Bukalapak will be subject to sanctions," Baskara explained to KompasTekno.

The External Communications Senior Lead for Tokopedia, Ekhel Chandra Wijaya, said the same thing. According to Ekhel, his party will take firm action against all forms of abuse on Tokopedia in accordance with the rules for using the platform.

"We also have the Abuse Reporting feature, where the public can report products that violate both the rules for using the Tokopedia platform and the laws that apply in Indonesia," added Ekhel.

Despite taking firm action against the sale of illegal goods, both Bukalapak and Tokopedia did not respond directly to the US government, which added their names to the 2021 Notorious Market List.

Apart from Bukalapak and Tokopedia, KompasTekno has also contacted Shopee regarding the entry of the Singapore-based marketplace to the list of companies supervised by the US in 2021. 


However, until this news was written, there has been no response regarding this matter.
